Sen. Johnson to FDA: Stop the Deeming Regs Now!

After months of being ignored by the FDA, one U.S. senator may finally get noticed by the federal agency. And it might mean better days ahead for the American vaping industry. Sen. Ron Johnson (R-Wisconsin), chairman of the Senate Homeland Security and Governmental Affairs Committee, has been pushing back against the FDA’s deeming regulations since they were announced.

Following the election, Sen. Johnson sent letters to three federal agencies asking them to stop enforcing regulations he says are likely to be reversed by the incoming Trump administration, along with the Republican 115th Congress. One of the letters was to FDA Commissioner Robert Califf.

“The U.S. Food and Drug Administration (FDA) deeming regulation of e-cigarettes is a primary example of a rule that could eliminate an entire nascent industry,” wrote Johnson. “Accordingly, given the substantial likelihood that this burdensome rule will be undone, I urge the FDA to cease implementation of its deeming regulation to spare the growing e-cigarette industry unnecessary and avoidable compliance costs that it currently faces.”

Sen. Johnson just won reelection himself, fighting a strong challenge from former senator Russ Feingold. Johnson credited vapers for helping him win the race. He also was an early supporter of Donald Trump, which will earn him some attention in the new administration. Though nothing is certain, the combination of a president eager to roll back regulation and a strong vaping supporter in the senate could mean good things for vapers and the vaping industry over the next year.

“During his historic re-election campaign, Senator Johnson pledged to Wisconsin vapers that he would fight for them,” said American Vaping Association President Gregory Conley. “With his leadership, we are hopeful that the new Congress will act to stop the FDA’s vaping rules from putting tens of thousands of Americans out of work.”

Smokers created vaping without any help from the tobacco industry or anti-smoking crusaders, and vapers have the right to keep innovating to help themselves.
